TERMS OF SERVICE

- WHO WE ARE
This online store is operated by Miguel Martins, sole trader, with address at Rua Dom Gaspar Leão, Lote 7A, R/C-F, 8600-721 Lagos, Portugal, under the trade name Sommelier Concierge ("we"). Contact: geral@sommconcierge.com | +351 927 309 103.
These Terms govern your use of the store and your purchases of products and services from it. Together with the Returns and Refunds Policy, the Shipping Policy and the Privacy Policy, they form the contract between you and us. By placing an order, you accept these Terms in the version in force on that date.
- MINIMUM AGE
We sell alcoholic beverages only to people aged 18 or over. By using the store and placing an order, you confirm that you are at least 18 years old. We may ask for proof of age and refuse or cancel orders, or the delivery, if there is any doubt about the age of the customer or of the person receiving the order. The same applies to wine tastings and events: we only serve alcoholic beverages to people aged 18 or over. - ACCOUNT
If you create an account, you are responsible for keeping your password secure and for making sure your details are correct and up to date. - PRODUCTS
We describe our wines as accurately as possible. Images are for illustration only: the colour, label or vintage may vary slightly. If a wine's vintage changes, we will state this on the product page or contact you before shipping. Wines are sold in cases of 6 bottles, or in multiples of 6, as indicated for each product. Quantities are limited to available stock. - ORDERS
An order is accepted when you receive our confirmation email. We may refuse or cancel an order, in particular due to lack of stock, an obvious pricing error, suspected fraud or doubts about the customer's age. In that case, we will immediately refund the full amount paid. Purchases are for personal use and not for resale. - PRICES AND PAYMENT
Prices are shown in euros and are final prices. VAT not applicable, exempt under article 53 of the Portuguese VAT Code. Shipping costs are shown at checkout, before you complete your purchase. The price that applies is the one in force at the time of the order. In the event of an obvious pricing error, we will contact you before shipping and you may choose between paying the correct price or cancelling the order with a full refund. Payment is made when you place the order, using the methods available at checkout. - SHIPPING AND DELIVERY
Shipping zones, costs and delivery times are described in the Shipping Policy. The delivery times shown are estimates. In any case, we will deliver your order within 30 days of confirmation at the latest, unless otherwise agreed. If we fail to do so, you may give us an additional period and, if that is not met either, cancel the order with a full refund.
The risk of loss of or damage to the products only passes to you when you receive the order. If the order arrives damaged or does not arrive, the "Damage and issues" section of the Returns and Refunds Policy applies. - RIGHT OF WITHDRAWAL, RETURNS AND WARRANTY
You have the right to withdraw from your purchase within 14 days, under the Returns and Refunds Policy, which sets out the conditions and exceptions. Products are covered by the legal guarantee of conformity provided by law. Nothing in these Terms limits your statutory rights as a consumer. - WINE TASTINGS, EVENTS AND CONSULTING
Tastings, private events and consulting services are provided under the conditions shown on each service page or in the proposal we send you (date, location, number of participants, price and payment terms). Tastings and events booked for a specific date are not subject to the right of withdrawal. You may ask to reschedule up to 5 days before the date, subject to availability. If we cancel, we will refund the full amount paid or offer a new date, as you prefer. At tastings and events, participants agree to drink responsibly. We may stop serving alcoholic beverages to anyone showing signs of intoxication or unable to prove they are over 18. - INTELLECTUAL PROPERTY
The texts, images, logos, the Sommelier Concierge name and other content of the store belong to us or are used with permission, and are protected by intellectual property law. You may not copy, reproduce or use them for commercial purposes without our prior written permission. Wine and producer names and trademarks belong to their respective owners. - THIRD-PARTY TOOLS AND LINKS
The store may include tools or links to third-party websites. We do not control these services and are not responsible for their content or practices. Please read their terms and policies before using them. - RELATIONSHIP WITH SHOPIFY
Sommelier Concierge is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Sommelier Concierge. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Sommelier Concierge, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Sommelier Concierge. - PRIVACY
How we process your personal data is described in our Privacy Policy. - REVIEWS AND COMMENTS
If you post reviews or comments on the store, you allow us to use them, free of charge, to promote the store and our products. Comments must not be false, offensive or unlawful, or infringe the rights of others, and we may remove them if they are. - PROHIBITED USES
You may only use the store for lawful purposes. You may not: use it for illegal or fraudulent purposes; transmit viruses or malicious code; provide false information or impersonate another person; send spam; collect other users' data; or use robots, scraping tools or other automated means to access the store without permission. We may suspend or close your account if you breach these Terms. - AUTOMATED AGENTS
Any software or service that accesses the store autonomously or semi-autonomously on someone's behalf ("Agent") must identify itself as such in every request, by stating "Agent/[agent name]" in the user agent string, must not imitate human behaviour or bypass CAPTCHAs or other control measures, and must answer truthfully when asked whether it is a human or a computer. We may limit or block any Agent's access. - LIABILITY
We are liable to you in accordance with the law. We are not responsible for failures or delays caused by force majeure or circumstances beyond our control, or for temporary interruptions of the website. Nothing in these Terms excludes or limits our liability where the law does not allow it, in particular towards consumers. - CHANGES TO THESE TERMS
We may update these Terms. The current version is always on this page, with the date of the last update. Changes do not apply to orders already placed: each order is governed by the Terms in force when it was placed. - GOVERNING LAW, COMPLAINTS AND DISPUTES
These Terms are governed by Portuguese law, without prejudice to the mandatory consumer protection rules of your country of residence. If you have a complaint, please contact us by email first. We have an electronic Complaints Book, at www.livroreclamacoes.pt. In the event of a consumer dispute, you may refer it to CIMAAL – the Algarve Consumer Dispute Information, Mediation and Arbitration Centre (www.consumoalgarve.pt | +351 289 823 135). More information at www.consumidor.gov.pt. - FINAL PROVISIONS
If any clause of these Terms is found to be invalid, the remaining clauses remain in force. If we do not exercise a right, this does not mean that we waive it. - CONTACT
